| What is the National Guard and its Duties From Wikipedia, the free encyclopedia The United States National Guard is a component of the United States Army (the Army National Guard) and the United States Air Force (the Air National Guard). The Militia Act of 1903 organized the various state militias into the present National Guard system. The Army National Guard is part of the United States Army, comprising approximately one half of its available combat forces and approximately one third of its support organization. The Air National Guard is part of the United States Air Force. Both are maintained through the National Guard Bureau, whose Chief is a Lieutenant General. Various State Militias also exist which are reserves to the National Guard and are collectively known as State Defense Forces. The State Militias, in some cases, pre-date the existence of the National Guard and are maintained on both an organized and unorganized level. The organized militia exists to supplement the National Guard in the event of manpower shortages while the unorganized militia comprises every able bodied male in a state which may be called up for extreme emergencies such as an invasion of the United States or a major catastrophe inside her shores. The last time that the unorganized state militias were activated was during the Civil War. Army National Guard units are trained and equipped as part of the United States Army; likewise, Air National Guard units are trained and equipped as part of the US Air Force. The same ranks and insignia are used and National Guardsmen are eligible to receive all United States military awards. The National Guard also bestows a number of state awards for local services rendered in a service member's home state. Traditionally, National Guard personnel serve "One weekend a month, two weeks a year", although a portion serve in a full-time capacity. This slogan has lost some of its relevance since the Iraq War, when up to 40% of total US forces in Iraq and Afghanistan consisted of mobilized personnel of the reserve components. Prior to the attacks against the United States on September 11, 2001, the National Guard's general policy regarding deployment was that Guardsmen would be required to serve no more than six months overseas at any time. Due to strains placed on active duty units following the attacks, the possible deployment time was increased to 18 months. Additional strains placed on military units as a result of the invasion of Iraq further increased the amount of time a Guardsman could be deployed to 24 months. Current Department of Defense policy is that no Guardsman will be involuntarily activated for a total of more than 24 months (cumulative) in one six year enlistment period (this policy is due to change 1AUG2007, the new policy states that soldiers will be given 24 months between deployments of no more than 24months, individual states have differing policies). | Phone Companies Facing Massive Lawsuits Questions Raised for Phone Giants in Spy Data Furor By John Markoff The New York Times Saturday 13 May 2006 The former chief executive of Qwest, the nation's fourth-largest phone company, rebuffed government requests for the company's calling records after 9/11 because of "a disinclination on the part of the authorities to use any legal process," his lawyer said yesterday. The statement on behalf of the former Qwest executive, Joseph P. Nacchio, followed a report that the other big phone companies - AT&T, BellSouth and Verizon - had complied with an effort by the National Security Agency to build a vast database of calling records, without warrants, to increase its surveillance capabilities after the Sept. 11 attacks. Those companies insisted yesterday that they were vigilant about their customers' privacy, but did not directly address their cooperation with the government effort, which was reported on Thursday by USA Today. Verizon said that it provided customer information to a government agency "only where authorized by law for appropriately defined and focused purposes," but that it could not comment on any relationship with a national security program that was "highly classified." Legal experts said the companies faced the prospect of lawsuits seeking billions of dollars in damages over cooperation in the program, citing communications privacy legislation stretching back to the 1930's. A federal lawsuit was filed in Manhattan yesterday seeking as much as $50 billion in civil damages against Verizon on behalf of its subscribers. For a second day, there was political fallout on Capitol Hill, where Senate Democrats intend to use next week's confirmation hearings for a new C.I.A. director to press the Bush administration on its broad surveillance programs. As senior lawmakers in Washington vowed to examine the phone database operation and possibly issue subpoenas to the telephone companies, executives at some of the companies said they would comply with requests to appear on Capitol Hill but stopped short of describing how much would be disclosed, at least in public sessions. "If Congress asks us to appear, we will appear," said Selim Bingol, a spokesman at AT&T. "We will act within the laws and rules that apply." Qwest was apparently alone among the four major telephone companies to have resisted the requests to cooperate with the government effort. A statement issued on behalf of Mr. Nacchio yesterday by his lawyer, Herbert J. Stern, said that after the government's first approach in the fall of 2001, "Mr. Nacchio made inquiry as to whether a warrant or other legal process had been secured in support of that request." "When he learned that no such authority had been granted, and that there was a disinclination on the part of the authorities to use any legal process," Mr. Nacchio concluded that the requests violated federal privacy requirements "and issued instructions to refuse to comply." The statement said the requests continued until Mr. Nacchio left in June 2002. His departure came amid accusations of fraud at the company, and he now faces federal charges of insider trading. The database reportedly assembled by the security agency from calling records has dozens of fields of information, including called and calling numbers and the duration of calls, but nothing related to the substance of the calls. But it could permit what intelligence analysts and commercial data miners refer to as "link analysis," a statistical technique for investigators to identify calling patterns in a seemingly impenetrable mountain of digital data. The law governing the release of phone company data has been modified repeatedly to grapple with changing computer and communications technologies that have increasingly bedeviled law enforcement agencies. The laws include the Communications Act, first passed in 1934, and a variety of provisions of the Electronic Communications and Privacy Act, including the Stored Communications Act, passed in 1986. Wiretapping - actually listening to phone calls - has been tightly regulated by these laws. But in general, the laws have set a lower legal standard required by the government to obtain what has traditionally been called pen register or trap-and-trace information - calling records obtained when intelligence and police agencies attached a specialized device to subscribers' telephone lines. Those restrictions still hold, said a range of legal scholars, in the face of new computer databases with decades' worth of calling records. AT&T created such technology during the 1990's for use in fraud detection and has previously made such information available to law enforcement with proper warrants. Orin Kerr, a former federal prosecutor and assistant professor at George Washington University, said his reading of the relevant statutes put the phone companies at risk for at least $1,000 per person whose records they disclosed without a court order. "This is not a happy day for the general counsels" of the phone companies, he said. "If you have a class action involving 10 million Americans, that's 10 million times $1,000 - that's 10 billion." The New Jersey lawyers who filed the federal suit against Verizon in Manhattan yesterday, Bruce Afran and Carl Mayer, said they would consider filing suits against BellSouth and AT&T in other jurisdictions. "This is almost certainly the largest single intrusion into American civil liberties ever committed by any U.S. administration," Mr. Afran said. "Americans expect their phone records to be private. That's our bedrock governing principle of our phone system." In addition to damages, the suit seeks an injunction against the security agency to stop the collection of phone numbers. Several legal experts cited ambiguities in the laws that may be used by the government and the phone companies to defend the National Security Agency program. "There's a loophole," said Mark Rasch, the former head of computer-crime investigations for the Justice Department and now the senior vice president of Solutionary, a computer security company. "Records of phones that have called each other without identifying information are not covered by any of these laws." Civil liberties lawyers were quick to dispute that claim. "This is an incredible red herring," said Kevin Bankston, a lawyer for the Electronic Frontier Foundation, a privacy rights group that has sued AT&T over its cooperation with the government, including access to calling records. "There is no legal process that contemplates getting entire databases of data." The group sued AT&T in late January, contending that the company was violating the law by giving the government access to its customer call record data and permitting the agency to tap its Internet network. The suit followed reports in The New York Times in December that telecommunications companies had cooperated with such government requests without warrants. A number of industry executives pointed to the national climate in the wake of the Sept. 11 attacks to explain why phone companies might have risked legal entanglement in cooperating with the requests for data without warrants. An AT&T spokesman said yesterday that the company had gotten some calls and e-mail messages about the news reports, but characterized the volume as "not heavy" and said there were responses on both sides of the issue. Reaction around the country also appeared to be divided. Cathy Reed, 45, a wealth manager from Austin, Tex., who was visiting Boston, said she did not see a problem with the government's reviewing call logs. "I really don't think it matters," she said. "I bet every credit card company already has them." Others responded critically. Seems that car thieves have found yet another way to steal your car or truck without any effort at all. The car thieves peer through the windshield of your car or truck, write down the VIN # from the label on the dash, go to the local car dealership and request a duplicate key based on the VIN #. My friend didn't believe this e-mail, so she called Chrysler-Dodge and pretended she had lost her keys. They told her to just bring in the VIN #, and they would cut her one on the spot, and she could order the keyless device if she wanted. The Car Dealer's Parts Department will make a duplicate key from the VIN #, and >> collect > >> payment from the thief who will return to your car. He doesn't have to break in, do any damage to the vehicle, or draw attention to himself. All he has to do is walk up to your car, insert the key and off he goes to a local Chop Shop with your vehicle. You don't believe it? It IS that easy. To avoid this from happening to you, simply put some tape (electrical tape, duct tape or medical tape) across the VIN Metal Label located on the dash board. By law, you cannot remove the VIN, but you can cover it so it can't be viewed through the windshield by a car thief. I urge you to forward this to your friends before some other car thief steals another car or truck. I slipped a 3 x 5 card over the VIN NUMBER. | Llamas and the Bird Tribe I have come across some information you may find of interest. Yesterday I happened to mention this to Dan Winter and he immediately made the connection to the bird tribes so now I am starting my own research. Our web site is www.nemetonsanctuary.net Part of our experience is that we live with three llamas. These are unusual animals that we were drawn to for their intuitive and mystical attributes. They are unique in the animal world in that they were never used in wars, such a elephants, horses and camels, but also, overall (not specifically) they have avoided the human food chain. A couple of months ago, we had one of our llamas seriously ill with a menengeal infestation from the overabundant deer that come into our grazing pasture. In the process of diagnosing and treating this condition, the vet told me that they had to send the blood samples away as he could not do them in his lab. I thought this was strange as it is a long established vet practice. He then explained to me that most mammals, including humans, have round blood platelets, with NO nucleus. Llamas are the only mammal that he knew of that have oval blood palettes, WITH a nucleus - like a bird. When you look into the face of a llama, there is a tremendous connection. Now I understand why they are so sensitive to the subtle energies around them and also why I was drawn to them. If you have anything on this or related ideas, please pass it along to me. I just ordered Ken Carey's book - Return of the Bird Tribes. | Arizona / West Illegal-entry tide surges toward Yuma By Jacques Billeaud The Associated Press Tucson, Arizona | Published: 05.18.2006 advertisementYUMA — Over the past year, this sandy stretch of desert in southwestern Arizona has become the nation's busiest immigrant-smuggling hot spot, a place of increasing banditry, violence, desperation and death. Border Patrol agents are seeing spikes in arrests of illegal immigrants and cases every day of criminals preying on border crossers. President Bush will be get an up-close look today when he visits Yuma as part of his push to overhaul the nation's immigration laws and tighten the 2,000-mile U.S.-Mexican border by sending up to 6,000 National Guardsmen in a backup role. A stretch to the east that includes Douglas and Nogales used to be the busiest spot along the border for illegal entrants trying to slip across. But authorities say a buildup there of border agents and surveillance technology caused a shift last year, pushing illegal immigrants toward the Yuma Border Patrol station. The shift is part of a common pattern seen in recent years: Crackdowns in one section of the border send illegal entrants and smugglers flooding to other areas, creating an ever-changing front. "Yuma is becoming the focal point," said Border Patrol spokesman Richard Hays. At the Yuma station, which oversees 62 miles of the border, authorities said agents are catching 300 to 450 illegal entrants a day, comparable to last year's numbers, but they are seeing unusual spikes, including 840 on a single day in March. Law enforcement authorities said the number of those who slip through is greater than the number caught, but they would not give any estimates. Along the entire 125-mile Yuma Sector, of which the Yuma station is a part, Border Patrol agents have made 95,000 arrests since Oct. 1, a 13 percent increase from this time last year, authorities said. The number of Border Patrol agents assigned to the sector has doubled to around 700 in the past year. An increasing number of illegal entrants who bypass fortified stretches of border are dying in the desert. Known deaths in the Yuma Sector hit a record 51 in 2005, up from 36 in 2004 and 15 in 2003. Daytime temperatures in Yuma can climb to around 120 degrees — 10 to 15 degrees hotter than around Tucson. Another danger: The area includes an Air Force bombing range. The Yuma station relies largely on patrolling agents, radar, sensors, cameras and observation towers. It has only a few miles of fences. Thirty minutes south of Yuma, in one of the more active parts of the region, there are two lines of defense: a 12-foot corrugated metal fence that divides the city of San Luis from Mexico, and, about 50 yards north of the border, an 8-foot chain-link fence topped with barbed wire and towers with surveillance cameras. Many homeowners in San Luis have wrought-iron fences around houses, and yet they cannot leave their garage doors open, for fear of thefts.
